The rate must be a genuine pre-estimate of loss; in some jurisdictions (including the UAE, under Article 390 of the Civil Code) a court or tribunal can adjust LDs that do not reflect actual loss, and "penalty" clauses may be treated differently. Check the cap and its basis (and whether other remedies survive the cap). This estimates exposure; it does not determine liability.
